1. Agreement to these terms
These Terms of Service form a binding agreement between you and Cuty AI covering your use of cuty-ai.com and all features offered through it.
2. Acceptance
By accessing Cuty AI, creating an account or making a payment, you confirm that you accept these terms in full.
3. Eligibility
You must be at least 18 years old and legally able to enter a contract. Cuty AI is not available to minors under any circumstance.
4. Nature of the service
Cuty AI provides entertainment through conversations with fictional companion characters generated by software.
5. Companions are fictional
Every character on Cuty AI is invented. No companion is a real person, and no message from a companion represents the views of a real individual.
6. Not professional advice
Nothing produced by a Cuty AI companion is medical, legal, psychological or financial advice. Consult a qualified professional for those matters.
7. Emergencies
Cuty AI is not a crisis service. If you or someone else is at risk, contact your local emergency number or a recognised support line immediately.
8. Account creation
You must supply accurate registration details and keep them current. One person may hold one account.
9. Account security
You are responsible for your password and for all activity under your account. Tell us promptly if you suspect unauthorised access.
10. Acceptable use
You agree not to use Cuty AI for anything unlawful, abusive, harassing, defamatory or infringing, and not to attempt to involve depictions of minors in any form.
11. Prohibited technical conduct
You may not scrape, reverse engineer, decompile, probe for vulnerabilities, overload our systems or bypass access restrictions on Cuty AI.
12. Automated access
Bots, crawlers and scripted clients may not interact with the chat features without our written permission.
13. Content you submit
You keep ownership of the messages you write. You grant Cuty AI a limited licence to store and process them solely to operate the service for you.
14. Generated content
Companion replies are produced automatically and may be inaccurate, inconsistent or unexpected. You use them at your own discretion.
15. Our intellectual property
The Cuty AI name, logo, character designs, imagery, written material, layout and code are owned by us or licensed to us and may not be reused without permission.
16. Limited licence to you
We grant you a personal, revocable, non-transferable licence to access Cuty AI for your own non-commercial enjoyment.
17. Free access
Free features are offered as they are, may carry usage limits and may change or end at any time.
18. Paid memberships
Paid plans grant additional features for the period purchased. Prices are shown before you confirm and include applicable taxes where required.
19. Automatic renewal
Memberships renew automatically at the end of each period at the published rate until cancelled.
20. Cancellation
You may cancel from your account settings at any time. Cancellation stops future charges and access continues to the end of the paid period.
21. Refunds
Except where consumer law requires otherwise, payments are non-refundable once the period has begun. Genuine billing errors are corrected.
22. Chargebacks
Raising a chargeback without first contacting support may result in immediate suspension of your Cuty AI account.
23. Price changes
We may change prices with reasonable notice. Changes apply from your next renewal, never retroactively.
24. Service availability
We aim for continuous availability but do not guarantee uninterrupted access. Maintenance, updates and outages happen.
25. Changes to features
We may add, modify or withdraw features of Cuty AI. Where a change materially reduces a paid benefit we will give notice.
26. Third-party services
Cuty AI relies on external providers for hosting, payment and delivery. Their availability is outside our control.
27. Suspension and termination
We may suspend or close an account that breaches these terms, harms other members or exposes us to legal risk.
28. Termination by you
You may close your Cuty AI account at any time. Closure ends your licence to use the service.
29. Effect of termination
On termination your access stops and your content is deleted in line with our retention practices, save for records we must keep by law.
30. Disclaimer of warranties
Cuty AI is provided on an as-is and as-available basis without warranties of any kind, express or implied, to the fullest extent permitted by law.
31. Limitation of liability
To the extent permitted by law, Cuty AI is not liable for indirect, incidental, special or consequential loss, or for loss of profit, data or goodwill.
32. Liability cap
Our total liability arising from your use of Cuty AI is limited to the amount you paid us in the twelve months before the event giving rise to the claim.
33. Indemnity
You agree to indemnify Cuty AI against claims arising from your misuse of the service or your breach of these terms.
34. Privacy
Our handling of personal data is described in the Cuty AI Privacy Policy, which forms part of this agreement.
35. Changes to these terms
We may revise these terms. Continued use of Cuty AI after revised terms take effect constitutes acceptance.
36. Governing law
These terms are governed by the laws applicable at the place of establishment of Cuty AI, without regard to conflict of law rules.
37. Dispute resolution
Please contact support first. Most issues are resolved informally, and we ask for thirty days to do so before formal proceedings.
38. Severability and entire agreement
If a provision is held unenforceable, the remainder stays in force. These terms and the Privacy Policy are the entire agreement between us.
